Mr. Cannabis Law has been at the forefront of the emerging industry of psychedelics. The Founder of Mr. Cannabis Law – Dustin Robinson – founded Mr. Psychedelic Law, which is a non-profit focused on responsible legal reform of psychedelics.
At a federal level, most psychedelics are still listed as Schedule I substances; however, the Food & Drug Administration (“FDA”) has demonstrated acceptance of these substances by (1) granting “Breakthrough Therapy” designation for psilocybin-assisted therapy for treatment resistant depression; and (2) greenlighting a phase III clinical trial for MDMA to treat PTSD. At a state level, Oregon is the first state to have passed a legalized framework for psilocybin mushrooms; and D.C. has decriminalized psilocybin mushrooms and other entheogenic plants and fungi. At a city level, the following cities have decriminalized psilocybin mushrooms and other entheogenic plants and fungi: Denver, Santa Cruz, Oakland, and Ann Arbor. The Mr. Psychedelic Law team has been talking with various cities in Florida about decriminalization; and we expect that several cities in Florida will decriminalize by the first quarter of 2021.
One psychedelic that has been receiving tremendous attention is ketamine. Unlike the other psychedelics, ketamine is a Schedule III substance. It has been approved as an anesthetic; and, recently, a ketamine nasal-spray (Spravato) was approved for depression. Many doctors are starting to use ketamine off-label for depression, PTSD, addiction, and various other mental health conditions. Clinics are quickly popping up where doctors administer the ketamine in their office. There are various laws that apply to off-label use of a FDA-approved drug; and Mr. Cannabis Law has assisted clients with navigating some of these complicated legal issues.
