With Nikki Fried at the helm as Commissioner of Florida’s Department of Agriculture and Consumer Services (FDACS), Florida’s hemp industry is ready to become a multibillion-dollar industry. A bill passed in Florida’s 2019 Legislative Session that directed FDACS to adopt rules to administer Florida’s hemp program. On April 16th, 2020, the USDA approved Florida’s hemp program. As a result, FDACS began the licensing process for hemp cultivators, hemp retailers, and hemp producers. Therefore, an operator must submit an application to FDACS and receive approval to create and sell hemp products in Florida. Although it appears Commissioner Fried and the Florida legislature intend on opening up the industry to the free-market, there will still be several legal and business obstacles in starting your hemp business.
