TCUP Program
Empowering Patients and Providers—The TCUP Program in Texas
The TCUP Program, short for Texas Compassionate Use Program, has transformed the path to medical cannabis for Texans facing serious and chronic conditions. With the passage of HB46 in June 2025, the Program reflects a more inclusive, patient-focused approach, all while maintaining the strong legal standards expected across the state.
Who is Eligible Under the TCUP Program?
Eligibility includes residents diagnosed with qualifying conditions as determined by a participating licensed physician. Chronic pain, traumatic injuries, and Crohn’s disease now join epilepsy, cancer, ALS, and more as eligible conditions under the revised TCUP Program.
The Steps to Access
- Find a Participating Physician: The TCUP Program requires all prescribers to be registry-listed and specialized in treating qualified conditions.
- Obtain a Legal Prescription: Unique to Texas, the program uses a true prescription method instead of recommendations, offering clarity and protection under state law.
- Fill at a Licensed Dispensary: Patients can access oils, edibles, patches, or inhalation forms—with each package holding no more than one gram of THC.
Compliance and Care
- Protections: Registered patients within the TCUP Program are protected from criminal prosecution for possession that meets legal definitions.
- No Out-of-State Reciprocity: Only Texas residents can benefit; out-of-state patients aren’t eligible.
- No Home Growing: All cannabis must originate from state-regulated, licensed businesses.
