Cannabis License Florida with Mr. Cannabis Law

In 2023, obtaining a cannabis license in Florida requires meeting several criteria set by the state’s Department of Health Office of Medical Marijuana Use (OMMU). Firstly, applicants must be Florida residents or entity that has been registered to do business in Florida for the previous five consecutive years. It is important to note that having a criminal record may disqualify you from getting a license.

The next step is to complete an application meeting all requirements as published in the OMMU’s guidance document titled “License Application Instructions, Requirements, and Forms.” The application will require basic information about the applicant, including their name, address, and tax identification number. In addition, applicants must provide detailed information about the proposed cannabis business, infrastructure, ability to secure infrastructure, security, experience in the marijuana industry, and diversity plan.  The Florida application is one of the most difficult in the United States, because the medical marijuana company must be fully integrated, handling all matters from cultivation, processing, packaging, dispensing, and delivery.

Finally, all applicants must consent to a level 2 background check, and must submit fingerprints to the state.  The application must be submitted to the OMMU in person, along with the $146,000 non-refundable application fee.  The Florida application process is very competitive and not all applicants will be approved.  If granted a license, the license must be renewed annually. The OMMU will also conduct regular inspections of licensed facilities to ensure they are operating in compliance with state regulations.
